Technology Media Telecoms (TMT) and Outsourcing

Our TMT and Outsourcing practice is closely linked to the firm's Corporate and M&A, Intellectual Property and Competition groups. Transactional expertise and legal know-how in protecting and enforcing IP rights is crucial for advising our clients on technology and business sourcing and the creation, allocation and exploitation of property rights in the relevant industries. Our expertise is aimed at advising, negotiating and implementing transactional structures and practical solutions that effectively address our clients' goals.

This practice group offers a wide range of transactional and regulatory work in technology, media and telecom matters, including outsourcing, hosting and ASP, online services, mobile entertainment, broadcasting, media and convergence issues, digital transformation, e-commerce, telecoms regulatory and transactional work, international roaming and MVNO (mobile virtual network operator) agreements, ICT contracts, complex IT projects, public procurement, software development, licensing and distribution structures, strategic business alliances and joint ventures.

We have extensive experience in outsourcing arrangements (both infrastructure outsourcings and BPO transactions) for national and multinational enterprises, such as telecommunication network outsourcing, network communication and security services, finance and accounting (F+A) outsourcings, HR/payroll, facility management, enterprise content management (ECM) and other managed services contracts. In our outsourcing practice, we regularly advise on business process and ICT arrangements also in regulated industries, including banks and securities dealers (back office, operation of core banking systems and street side processes execution, custody and correspondence banking), (re)insurance companies, postal services, audit firms, and telecommunications.

As regards media and entertainment law, we advise broadcasters, media companies and content providers active in print and online media, TV, radio and cinema operators, on regulatory, licensing, advertising and sponsoring matters, performance marketing and social media as well as content regulation and liability aspects. We frequently represent clients before Swiss regulatory authorities.
