    Cécile Berger Meyer est une associée de notre bureau de Genève, où elle dirige le groupe Immobilier. Elle conseille une clientèle tant privée qu’institutionnelle sur l’ensemble des problématiques liées au droit immobilier et au droit de la construction. Son expertise couvre notamment l’acquisition et la cession d’actifs immobiliers, la structuration et le financement d’investissements immobiliers, ainsi que les questions relevant du droit administratif, de l’aménagement du territoire, des procédures d’autorisation de construire, des restrictions à l’acquisition d’immeubles par des personnes à l’étranger, et du droit des marchés publics.

    En parallèle de son activité juridique, Cécile est activement impliquée dans le secteur immobilier suisse. Elle occupe le poste de Vice-Présidente de l'Association Suisse de l’économie immobilière (SVIT Suisse), ainsi que celui de Présidente de la Commission d'examen de la Fédération Suisse des Avocats (FSA) en droit de la construction et de l'immobilier. Elle a également exercé pendant de nombreuses années lla fonction de juge auprès de la Commission de conciliation en matière de baux et loyers et du Tribunal des baux et loyers. Elle siège aujourd'hui au sein de plusieurs comités, dont le comité d’investissement d’une caisse de pension suisse alémanique, et est également membre de conseils d’administrations de plusieurs sociétés actives dans l'immobilier.

Revised transparency rules on rents

On 21 March 2025, the Swiss Federal Council adopted amendments to the Ordinance on the Rent and Lease of Residential and Commercial Premises. The amendments primarily concern the notification of the previous rent for residential leases with the official form in those cantons that have declared such form to be mandatory. Furthermore, the amendments also concern the formal requirements for notifying a rent increase in the case of staggered rents – mere written notification will now be sufficient. The changes will come into force on 1 October 2025.

Lex Koller : suspension temporaire de l’acquisition d’établissements stables par des étrangers ?

Lex Koller : suspension temporaire de l’acquisition d’établissements…

Avec un vote étonnamment clair de 22 voix contre 0 et deux abstentions, la Commission des affaires juridiques du Conseil national a adopté une initiative dont le but est de suspendre temporairement l’exemption d’autorisation offerte par la Lex Koller pour l’acquisition de biens qualifiant d’établissements stables. Selon la Commission, cette mesure vise à éviter que les entreprises suisses mises sous pression par la crise COVID-19 ne soient contraintes de vendre leurs locaux commerciaux à des entreprises étrangères à des conditions trop favorables. L’initiative parlementaire est actuellement examinée par la Commission des affaires juridiques du Conseil des États. Si cette initiative était acceptée et que la modification législative était considérée urgente, cette dernière pourrait être adoptée et entrer en vigueur en quelques mois seulement.
