    Dominique Müller is co-leading the Investigations and White Collar practice groups at our firm’s Zurich office. He advises on white collar, administrative, regulatory and internal investigations. As a seasoned litigator, Dominique represents parties in proceedings before Swiss courts, criminal prosecution and administrative authorities, as well as in international mutual legal assistance proceedings. His expertise encompasses general commercial litigation, with a particular focus on takeover and corporate litigations. Dominique also handles litigious employment matters and practices restructuring and insolvency law.

La vidéoconférence est aujourd’hui largement utilisée pour l’audition de parties, de témoins et d’experts dans les procédures civiles transfrontalières. En Suisse, le droit en vigueur requiert toutefois une autorisation préalable des autorités pour participer à une audience devant un tribunal étranger par vidéoconférence. Le non-respect de cette exigence est contraire à l’article 271 du Code pénal suisse (CP) et susceptible de constituer une infraction pénale. Afin de faciliter la participation volontaire à des procédures judiciaires étrangères par des moyens de communication électroniques – ce qui répond souvent à l’intérêt des parties séjournant en Suisse –, le Parlement suisse a adopté de nouvelles dispositions sur l’utilisation des moyens de communication électroniques dans le cadre de procédures civiles transfrontalières. À compter du 1er janvier 2026, il ne sera ainsi plus nécessaire d’obtenir une autorisation préalable pour participer à une audience devant un tribunal étranger. Une notification préalable aux autorités suisses suffira, sous réserve du respect de certaines conditions. Les nouvelles dispositions assouplissent également les restrictions applicables à la production volontaire d’informations dans le cadre de procédures civiles étrangères.

Swiss-US Data Privacy Framework – Swiss adequacy decision for US certified…

At its meeting of 14 August 2024, the Swiss Federal Council recognized the adequacy of data protection applicable to transfers of personal data to US companies certified under the "Data Privacy Framework" (DPF). The United States will be added to the list of countries with an adequate level of data protection with effect as from 15 September 2024, limited to US companies certified under the DPF. This decision will facilitate transfer of personal data to the US under the new DPF, and also more generally.
