Lenz & Staehelin represents ewz Übertragungsnetz AG

In April 2009 the Federal Electricity Commission (ElCom), Switzerland’s regulatory authority in the electricity sector, lowered the value of ewz’ transmission network infrastructure in the context of a review process of costs and tariffs for the use of the transmission network from CHF 278 million to CHF 107 million. Also in the subsequent years 2010, 2011 and 2012 ElCom reduced ewz’ transmission network validation on the same principles. ewz successfully appealed these decrees to the Federal Administrative Court. For 2009, 2010 and 2011 the court confirmed ewz’ approach to network validation in all major aspects. The proceedings for 2012 are still pending.
