    Hikmat Maleh is a partner and criminal and commercial litigator who co-leads the Investigations practice in Geneva. He represents clients in complex litigation before Swiss criminal and civil courts, often in multi-jurisdictional proceedings. Hikmat routinely handles white collar crime cases (fraud, money laundering, bribery, insider trading, mutual legal assistance), banking litigation, commercial disputes, and employment litigation, among others. He also advises clients on sanctions compliance and represents them in sanctions-related disputes or enforcement.

    Hikmat is the hiring partner for our Geneva and Lausanne offices.

Switzerland continues aligning its sanctions regime to the European Union (EU) sanctions against Russia. On 29 February 2024, the Federal Department of Economic Affairs, Education and Research (DEFR) adopted further measures against Russia, in line with the 13th sanctions package adopted by the EU. Alongside, the State Secretariat for Economic Affairs (SECO) has updated its FAQ document, providing further clarifications notably on the asset freeze and contractual obligations aimed at preventing re-exportation to Russia.

Swiss sanctions against Russia – Implementation of the EU 12th Sanctions…

The Swiss Federal Council continues aligning the Swiss sanctions regime to the EU sanctions against Russia. On 31 January 2024, the Swiss Federal Council adopted further measures against Russia, in line with the 12th sanctions package adopted by the European Union (EU). This follows a move on 21 December 2023 where the Federal Department of Economic Affairs, Education and Research (DEFR) added 147 individuals and entities to the Swiss sanctions list. The latest measures impose additional commercial and financial sector restrictions, including a ban on the importation of diamonds, pig iron, and liquefied petroleum gas (LPG). In the financial sector, these sanctions extend to prohibiting Russian nationals and residents from holding controlling stakes in Swiss companies that provide crypto-asset services, alongside stringent enforcement of the oil price cap on Russian crude oil and petroleum products to curtail Russia's oil revenue.
