ComCo holds that Swisscom did not violate Swiss Competition Law
Lenz & Staehelin has again successfully defended Swisscom, Switzerland's largest telecom provider, in a competition law investigation.
Last year, the Federal Supreme Court, in a landmark judgment, upheld an appeal by Swisscom against a CHF 7.5 million fine (see Deals & Cases, dated 19 April 2024). Now, Lenz & Staehelin secured another win for Swisscom in an investigation that the Competition Commission had opened in 2020. The case concerns the issue whether Swisscom had charged too high prices in various tenders for projects to network company locations as well as towards its competitors for accessing its broadband network infrastructure. In its decision, the Competition Commission held that Swisscom did not abuse a dominant position and therefore did not infringe Competition Law. Consequently, the authority closed the investigation without further consequences for Swisscom.
