Viagra price recommendations - Court annuls competition law sanction against Pfizer AG

By decision of 3 December 2013, the Swiss Federal Administrative Court annulled the sanction against Pfizer AG that was imposed by the Swiss Competition Commission in 2009. Pfizer issued non-binding price recommendations for the drug Viagra that were primarily directed at pharmacies and self-dispensing doctors in Switzerland. Upon Pfizer’s appeal, the Court reversed the allegations of the Competition Commission that Pfizer’s recommendations would have amounted to resale price maintenance and annulled the whole fine for Pfizer AG of several millions of Swiss Francs.

Pfizer AG was represented before the Federal Administrative Court by a team consisting of Marcel Meinhardt and Felix Prümmer.
