Alpiq settles transaction dispute with Bouygues

Lenz & Staehelin advised and acted as second counsel (in addition to Homburger) to Alpiq and its board in connection with a dispute following Bouygues’ purchase of Alpiq Engineering Services for CHF 850 million. The transaction closed in July 2018 but both parties filed for arbitration in February 2019, invoking a post-purchase price adjustment mechanism in their share purchase agreement. In the arbitration, Bouygues claimed around EUR 300 million. In December 2020, the parties agreed on a settlement payment by Alpiq to Bouygues of CHF 54.5 million (EUR 49.4 million).
