Internationale Schiedsgerichtsbarkeit und Kartellzivilrecht

Die gegenwärtige Revision des schweizerischen Kartellrechts strebt explizit die Stärkung des Kartellzivilrechts und damit eine Erhöhung der Relevanz von Zivilverfahren an, in denen kartellzivilrechtliche Ansprüche geltend gemacht werden. Auch in der Schiedsgerichtsbarkeit gewinnt das Thema zunehmend an Bedeutung. Dieser Entwicklung stehen allerdings in der Praxis gerade für grenzüberschreitende Schiedsverfahren einige Hürden gegenüber. Das vorliegende Buch untersucht solche Hindernisse und unterbreitet konkrete Lösungsvorschläge. Im Fokus stehen dabei die Frage nach der Qualifikation kartellrechtlicher Bestimmungen als Eingriffsnormen ebenso wie die Frage nach der Zugehörigkeit kartellrechtlicher Normen zum ordre public.

As of 1 July 2025, the Swiss Arbitration Centre offers a new framework for increased efficiency in private client arbitration proceedings, with the entry into force of the Supplemental Swiss Rules for Trust, Estate and Foundation Disputes ("TEF Rules"). The TEF Rules are a tailor-made supplement to the existing Swiss Rules of International Arbitration ("Swiss Rules"), which aim to cater to the specific requirements of inheritance disputes, as well as internal disputes arising in connection with trusts and foundations.

In a continued effort to align with European Union ("EU") sanctions, on 14 May 2025, the Swiss Federal Council implemented additional measures transposing the core components of the European Union's 16th sanctions package adopted on 24 February 2025. The new Swiss measures entered into force on 15 May 2025 and reinforce the existing framework through enhanced trade restrictions, territorial extensions and service bans. These include, inter alia, the expansion of Article 28e UKRO to non-government-controlled areas of Ukraine and reinforced prohibitions on Russian infrastructure and financial messaging services.
