Schweiz – Europäische Union, Grundlagen, Bilaterale Abkommen, Autonomer Nachvollzug

Die schweizerische Europapolitik steht auf dem Prüfstand. Der Bundesrat und die Europäische Kommission schlagen vor, die bestehenden Abkommen auf eine neue institutionelle Grundlage zu stellen und zusätzliche Abkommen abzuschliessen. Der damit einhergehende Integrationsschritt fordert das Staats- und Demokratieverständnis in der Schweiz heraus. Gleichzeitig ist das ausgehandelte Vertragspaket eine Voraussetzung für die Weiterführung des bilateralen Wegs. Andernfalls besteht die Gefahr, dass dieser Weg erodiert. Das wäre keine verlockende Perspektive - weder für die Schweiz noch für die EU. Höchste Zeit also, die rechtlichen Beziehungen der Schweiz zur EU näher kennenzulernen! Es zeigt sich, dass die Doppelstrategie der völkerrechtlichen Anbindung und der selbstgewählten Anpassung zu einer weitgehenden Integration der Schweiz in das Recht der EU geführt hat - deutlich weitgehender als dies einer breiten, auch juristisch fachkundigen Öffentlichkeit bewusst ist.

<p>In decision 4A_305/2025 of 13 March 2026, the Swiss Federal Supreme Court held that Swiss sanctions against Russia are overriding mandatory law and apply irrespective of the otherwise applicable law. The Court reasoned that the Swiss Ukraine Ordinance serves Switzerland’s core foreign-policy objectives and therefore applies as overriding mandatory law. In this case, the Court held that the sanctions barred enforcement of the award in Switzerland and treated the claim as unenforceable while the sanctions remain in force.</p>

On November 29, 2020, the "Responsible Business Initiative" has been rejected by a majority of the Swiss cantons. As a result, the indirect counter-proposal adopted by the Swiss parliament will most likely enter into force. The counter-proposal imposes extensive non-financial reporting duties on large publicly traded companies and regulated financial institutions notably in relation to environmental, social and employment-related matters, respect for human rights as well as anti-corruption. It also lays down additional due diligence duties with regard to conflict minerals, and child labor.
