Natural resources exploitation: business and human rights (Editor)

Can natural resources exploitation continue as a no-limit business? If measures have to be taken, what are they? Are compromises possible or should certain activities simply be stopped or dramatically reduced, with the economic consequences that we can imagine, including for employees?

Distinguished speakers of diverse backgrounds examined these issues during the Main Theme Session on “Natural Resources Exploitation: Business and Human Rights”, held on 28 October 2017 during the UIA’s 61st Congress in Toronto.

This fourth book in the UIA-LexisNexis Publications Collection contains the speakers’ written contributions to the Congress, as well as contributions of other experts in the field, and examines the legal issues arising from the exploitation of natural resources on a legislative, administrative and contractual level, in addition to focusing on compliance mechanisms, dispute resolution and other mechanisms for redress.

As of 1 July 2025, the Swiss Arbitration Centre offers a new framework for increased efficiency in private client arbitration proceedings, with the entry into force of the Supplemental Swiss Rules for Trust, Estate and Foundation Disputes ("TEF Rules"). The TEF Rules are a tailor-made supplement to the existing Swiss Rules of International Arbitration ("Swiss Rules"), which aim to cater to the specific requirements of inheritance disputes, as well as internal disputes arising in connection with trusts and foundations.

In a continued effort to align with European Union ("EU") sanctions, on 14 May 2025, the Swiss Federal Council implemented additional measures transposing the core components of the European Union's 16th sanctions package adopted on 24 February 2025. The new Swiss measures entered into force on 15 May 2025 and reinforce the existing framework through enhanced trade restrictions, territorial extensions and service bans. These include, inter alia, the expansion of Article 28e UKRO to non-government-controlled areas of Ukraine and reinforced prohibitions on Russian infrastructure and financial messaging services.
