    Dr. Valérie Menoud is a partner and leading practitioner in our Banking and Finance group and co-heads the Investigations practice in Geneva. She specializes in banking, financial services and corporate law. With a focus on serving clients in the banking, insurance and wealth management sectors, she advises on a wide range of issues, including regulatory, compliance, and contractual matters. Valérie regularly assists in proceedings and represents clients before the Swiss Financial Market Supervisory Authority (FINMA) and other authorities. Her expertise also covers corporate reorganizations, governance, ESG, and sustainable finance.

New European mandatory human rights and environmental due diligence…

On 14 December 2023, the Council of the EU and European Parliament reached a provisional agreement on the Corporate Sustainability Due Diligence Directive ("CSDDD"). This directive will mandate comprehensive due diligence from large EU and non-EU companies, targeting actual and potential adverse impacts on human rights and the environment of their business operations, including those of subsidiaries and business partners. Significantly, the CSDDD is expected to impact non-EU companies, both directly and indirectly. Therefore, it is crucial for all relevant stakeholders to actively monitor the directive's implementation process, from early stages on.

Federal Council plans to expand corporate sustainability reporting…

On September 22, 2023, the Swiss Federal Council announced its key guiding principles for amending the Swiss corporate sustainability reporting obligations. After previously signaling its ambition to align the Swiss reporting requirements with international standards, it does not come as a surprise that the Federal Council affirmed its intention to further align the Swiss reporting obligations with the European Union's Corporate Sustainability Reporting Directive (CSRD), notably by extending the current rules' scope of application and by introducing an audit requirement. A detailed draft of the proposed changes is anticipated by mid-2024.
